LEGAL ASSESSMENT OF DECISION MAKING LOGIC BY CIVILIAN AIRCRAFT CREWS IN THE CONTEXT OF SECURITY THREATS

Objective: to determine the legal models of the specific features of the logic of decision making by the crews of civil aircraft and the consequences of such decisions. To propose effective mechanisms for improving the level of safety of crews of civil aircraft. To offer author’s models of safety decision making by crews of civilian aircraft. Methods: the study was conducted using classical methods of scientific knowledge. Using the method of analysis, the system elements of the decision-making logic are revealed. With the help of the synthesis method, variants of negative consequences of decision-making are considered. Results: According to the results of the study, the types of negative consequences of the decisions were determined. Identified and disclosed components of aviation incidents. Elements of aviation security are established.
Aviation is of particular interest to aviation security as a component of aviation activity. The administrative aspect of this area lies in several basic aspects: the first aspect is security as a category of administrative law; the second aspect is safety as a state of maintenance of activities and the third aspect is safety as a consequence of the activity of the crew of an aircraft civilian.
The problem of ensuring the safety of flights was and remains today extremely relevant. It is necessary to determine the problem with the position of system legal analysis. The provision of complete flight safety today is not technically feasible, however, experts from various scientific fields, including lawyers, are being asked to use a variety of tools and measures, including legal ones, to ensure a high level of safety and reliability of air transport.
Flight safety determines the ability to perform flights without a threat to human life and health, the ability to perform flights so that the risk of injury to or damage to people, damage, including the environment, has been limited to «acceptable » level.
