GENERAL THEORETICAL CONCEPTUAL AND CONTENT PRINCIPLES OF HUMAN RIGHTS RESEARCH

Purpose: to determine the methodological principles of the formation of the categorical apparatus of legal science and the formulation of legal concepts, to analyze and summarize the definitions of the concept of human rights proposed in legal studies, encyclopedic, reference and popular science publications, to determine the main features of the defined concept and propose an author’s definition. Research methods: comparative-analytical, structural-semantic, syntactic, generalization of scientific works and legislative acts, classification, etc. Results: the theoretical and methodological principles of the formation of the categorical-conceptual apparatus of the study of human rights in the modern world are determined, the main scientific approaches to determining the content of the concept of the principle of equality in law, which are proposed by lawyers, encyclopedic, reference and popular science literature, are analyzed and summarized, on the basis of which the corresponding author’s definition is formulated. Discussion: the relevance of defining the conceptual and substantive principles of human rights research in the modern world as an exceptionally important aspect of the study of the specified problem, which has been repeatedly addressed by both domestic and foreign scholars in the fields of jurisprudence, political science, philosophy, public administration and other sciences, is substantiated. It is emphasized that civilizational progress is constantly expanding the issues of human rights, which requires the corresponding improvement of the relevant terminology. The methodological principles of such a definition are a system-centric approach, and the main aspects are structural-semantic, orthological and functional-semantic. An analysis, generalization and systematization of various definitions of human rights definitions are carried out and a number of features that are system-forming are highlighted, on the basis of which the author’s definition of the studied concept is proposed.
